Animals can certainly be dangerous on Kentucky’s roadways. In 2011 a woman in Estill County died after a car hit a horse on Highway 52. The horse was knocked into her lane of travel, causing her to hit the horse a second time, and knocking it back into the other lane where a third car hit it. The other two drivers were also injured and the horse died as well.
In Kentucky, if animals roaming freely cause injuries to others the owner is liable for the damages. Owners of livestock must ensure their animals are in proper enclosures and can be liable even if the animal was in an enclosure but managed to get out.
