U.S. Government Claims Immunity in Tort Claim

An FBI agent wrecked a rare Ferrari, and the goverment is now refusing to pay the insurance company the value of the car.  The Ferrari, a 1995 F50, was being stored in Lexington, Kentucky as part of an investigation on stolen vehicles.  In May 2009 an FBI agent went for a ride in the car when he lost control and landed against bushes and a tree.

The Ferrari is insured by Motors Insurance Co. who is suing the U.S. Justice Department for $750,000.  Motors Insurance claims the vehicle is a total loss.  The Justice Department, however, is refusing to pay the claim because the goverment says it is immune to tort claims when certain goods are handled by law enforcement. 

The next court date in the case is June 13.
